Product Terms & Limited Warranty

These Product Terms and Limited Warranty apply to products designed, manufactured, or supplied by Envisionary Images, LLC. A written proposal, invoice, purchase order, or project agreement may contain additional or different terms. If there is a conflict, the signed or accepted project-specific document controls.

One-year limited warranty

Envisionary Images, LLC warrants its products against defects in materials and workmanship for one (1) year from the date of delivery under normal commercial use. This warranty covers parts and reasonable labor when a product component fails, comes apart, or otherwise has a defect that is clearly attributable to Envisionary Images.

For a valid warranty claim, Envisionary Images may, at its option, repair the product, replace the affected component or product, substitute a reasonably comparable product, or provide another mutually acceptable remedy. These remedies are exclusive to the extent permitted by law.

What the warranty does not cover

This limited warranty does not cover damage or defects caused by:

  • Negligence, abuse, misuse, vandalism, accidents, or use for a purpose other than the product’s intended purpose.
  • Improper cleaning, maintenance, care, installation, assembly, anchoring, modification, repair, or reinstallation by anyone other than Envisionary Images or its authorized representative.
  • Exposure to chemicals, excessive moisture, liquids, heat, sunlight, environmental conditions, or other conditions inconsistent with normal commercial use.
  • Damage during relocation, moving, storage, unloading, handling, or installation after delivery.
  • Normal wear and tear, cosmetic wear, or natural aging of materials and finishes.
  • Products resold or transferred to another owner, unless otherwise agreed in writing.

Custom-product variations

Because products are custom manufactured and many materials have natural variation, finished dimensions, wood grain, color, sheen, texture, pattern, and other characteristics may vary slightly from samples, drawings, renderings, photographs, printed illustrations, video, or Internet displays. Reasonable variations of this kind are normal and are not considered defects.

Transit damage and delivery inspection

The customer must inspect all packages and products promptly upon delivery. Visible or suspected transit damage must be reported to Envisionary Images within twenty-four (24) hours of delivery and documented with photographs of the product, packaging, shipping label, and damage. Failure to provide timely notice and documentation may jeopardize the ability to obtain compensation from the carrier.

Site conditions, codes, and customer responsibilities

Before ordering, installation, or use, the customer is responsible for confirming site dimensions, access, floor conditions, utilities, anchoring needs, and all applicable building, fire, electrical, plumbing, accessibility, and other codes or regulations.

Envisionary Images does not represent that a product automatically complies with every rule, code, or regulation applicable to the customer’s specific site or use. The customer must disclose all known requirements before approving an order. Customer approval of shop drawings constitutes acceptance of the stated dimensions, materials, finishes, layout, and design details.

Payment terms

Unless otherwise agreed in writing, all new customers must pay the full project price before design or production work begins.

Approved alternate terms may include a seventy-five percent (75%) deposit before work begins and the remaining twenty-five percent (25%) before shipment. When those terms apply, Envisionary Images will provide photographs of the completed product for review before requesting final payment. Products will not be released or shipped until all amounts then due have been received.

Quotes, changes, and cancellations

Unless otherwise stated, quotations are valid for thirty (30) days. Pricing, materials, lead times, freight costs, and availability may change after that period.

Because products are made to order, an order may not be canceled after design, purchasing, fabrication, or other production work has begun unless Envisionary Images agrees in writing. Approved changes may affect price and delivery timing.

Installation, handling, and risk after delivery

Unless installation is expressly included in a written agreement, the customer is responsible for unloading, moving, assembly, installation, anchoring, electrical connections, plumbing connections, and safe use after delivery. Envisionary Images is not responsible for damage or injury arising from improper handling, installation, modification, relocation, or use after delivery.

Delays outside our control

Envisionary Images is not responsible for delays or nonperformance caused by circumstances beyond its reasonable control, including material shortages, supplier delays, freight disruptions, labor interruptions, severe weather, natural disasters, governmental actions, tariffs, utility failures, or similar events. We will make reasonable efforts to communicate material delays and resume performance when practical.

Photography and portfolio use

Unless otherwise agreed in writing, Envisionary Images may photograph completed products and projects and use those photographs for its website, portfolio, advertising, social media, print materials, and other promotional purposes. We will make reasonable efforts not to disclose confidential customer information.

Disclaimer and limitation of liability

TO THE EXTENT PERMITTED BY LAW, ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED. SOME STATES DO NOT ALLOW CERTAIN WARRANTY LIMITATIONS, SO THESE LIMITATIONS MAY NOT APPLY IN EVERY CASE.

TO THE EXTENT PERMITTED BY LAW, ENVISIONARY IMAGES, LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LEGALLY BE LIMITED.

Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
